Terms of Service

These Terms of Service ("Terms") govern your use of the SaveOnSwipes website ("Site") and the statement audit service ("Service") provided by SaveOnSwipes, a brand operated by AspenPeak LLC.

1. Eligibility

The Service is intended for US-based businesses with active card processing relationships. By using the Service, you represent that you have the authority to act on behalf of the business whose statements you submit.

2. The Audit Service

When you submit a merchant statement, we will provide a written audit identifying:

• Your effective processing rate
• Line items that may be negotiable
• An estimate of what you would pay if you switched to one of our recommended processors

The audit is provided as informational analysis only. It is NOT a guarantee of specific savings, and your actual savings will depend on the terms ultimately offered by the processor you elect to use, your transaction volume, and other factors outside our control.

3. No Obligation

The audit is free and creates no obligation to switch processors or purchase any service from SaveOnSwipes or AspenPeak LLC. The audit is yours to keep regardless of whether you elect to engage further.

4. If You Choose to Switch

If you decide to onboard with a processor we recommend (Square, Fiserv, Worldpay, or TSYS), you will enter into a separate agreement directly with that processor. SaveOnSwipes facilitates the introduction and onboarding but is not a party to the resulting processing agreement. Your relationship for processing services is between you and the processor.

5. Acceptable Use

You agree not to:

• Submit statements for businesses you are not authorized to represent
• Submit fraudulent, altered, or forged documents
• Use the Service to compete with SaveOnSwipes or AspenPeak LLC, or to extract our pricing or methodology for competitive purposes
• Reverse engineer, scrape, or attempt to gain unauthorized access to our systems

6. Disclaimers

The Service is provided "as is." We do not warrant that the audit will be free of errors or that you will achieve any specific savings. Industry rates, fees, and processor terms change frequently; an audit reflects conditions at the time it was produced.

AspenPeak LLC is not a bank or financial institution.

7. Limitation of Liability

To the maximum extent permitted by law, SaveOnSwipes' and AspenPeak LLC's total liability arising out of or relating to your use of the Service shall not exceed $100. We are not liable for indirect, incidental, consequential, special, or punitive damages.

8. Governing Law

AspenPeak LLC is a Delaware limited liability company. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts of the State of Delaware.

9. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance.
